Most MM2H writing describes what you must have. Fewer say who actually decides, and applicants are routinely surprised by the answer.
Three bodies, three roles
The licensed operator lodges it. An application must be submitted and completed through an MM2H tour operating business licensed by the Ministry of Tourism, Arts and Culture under the Tourism Industry Act 1992 (Act 482). That statute is why the licence exists and why you cannot file directly yourself.
The One Stop Centre processes it. Every application, from new participants and existing principals alike, is conducted through the One Stop Centre, MM2H (OSC MM2H).
The Immigration Department decides it. All matters concerning immigration, including the final approval, are under the jurisdiction of the Ministry of Home Affairs through the Immigration Department. Appeals go there too.
The practical consequence: the ministry that runs the programme is not the ministry that approves your application. An agent promising to expedite an approval is describing influence over a body it does not deal with.
Who may apply
Participation is open to eligible foreign individuals from sovereign countries that have diplomatic relations with Malaysia.
The age floor differs by category, which is easy to miss:

Once approved, a participant is referred to throughout the programme documents as the principal. The term matters later, because dependants, transfers on death and renewal conditions are all written in terms of the principal.
The forms that exist
The ministry publishes these directly, which is worth knowing before an agent presents them as proprietary work product:
- IM38, the visa application form
- the personal bond form
- Medical Form II
- IMM.12, the visit pass application form
- a required resume format
It also publishes the panel list of clinics, hospitals and medical centres for the compulsory medical check-up, and a list of insurance companies.
What happens after approval
Approval is not the end of the obligations, it is the start of them. The medical check-up is compulsory after approval, for the principal and every dependant. The purchase of a residence is compulsory after approval. And up to half the fixed deposit unlocks only once you are approved.
That ordering catches people out: the property and the medical are conditions of remaining a participant, not hurdles you clear to become one.
What actually happens at the counter
The Immigration Department publishes its own guidelines for each MM2H transaction, with a client charter attached. These are the operational realities the programme pages do not mention.

Two constants run through all of them.
Someone has to be physically present. Every guideline opens with the same line: the applicant or a representative of the MM2H company must attend. This is not a process completed by post or portal, and it is a large part of what a licensed company actually does for a client living abroad.
The paperwork is standardised and public. Form IMM.12 for the pass, Form Imm.55 for renewals and endorsement transfers, Medical Form II for the medical report, and a personal bond stamped RM10. The department publishes all of them, so a company presenting these as proprietary work product is overstating its role.
Health insurance is required for those below 60. The category pages state health insurance at renewal without qualification; the Immigration guidelines attach it to applicants under 60. If you are over 60, ask which applies before buying a policy you may not need.
One dependant rule that catches families out
A dependant aged 21 and above holding an MM2H dependant pass will not be given a further extension. Children may remain dependants up to 34 while unemployed and single under the programme rules, but the extension guidance at the counter is stricter, and a dependant turning 21 mid-pass is a case to raise with your company early rather than at renewal.
Study permission carries its own line: it is for applicants below 18. A dependant over 18 applies for a student pass instead, a different transaction with a different charter.
